Terms of Service

Current version · September 14, 2026

These Terms govern the business use of WOWZONE AI Worker and related managed services. The customer contracting the service represents that it has authority to contract on behalf of the company identified in the order, proposal or onboarding flow.

1. Service

WOWZONE provides a managed AI Worker service configured for the customer’s business. The service may include conversational assistance, catalog or service search and recommendation, opportunity qualification, collection of requests or scheduling data, authorized integrations, transfer to human personnel, analytics, onboarding and related automations. Features depend on the selected plan, industry, configuration and availability of third-party services.

2. Orders, plans and fees

The applicable order, checkout or accepted proposal identifies the plan, setup fee, recurring fee, currency, included usage and any promotion. Recurring charges continue according to the billing cycle until cancellation under the terms of the applicable order. Taxes and legally required tax documents are handled according to the customer transaction and the corresponding jurisdiction.

2.1 Returns and refunds

Where a refund is legally or contractually due for a failure, breach or impact directly attributable to and proven against WOWZONE, including a situation not expressly anticipated in these Terms, the maximum refund will be limited to the last payment actually made by the customer to WOWZONE for the affected service, to the maximum extent permitted by applicable law. No refund will be due for events attributable to the customer, its authorized users or third parties, or for external failures excluded under these Terms. Implementation, configuration or work already performed and third-party costs already incurred are non-refundable except where required by applicable law or expressly agreed in writing.

3. Customer responsibilities

The customer, its administrators and persons authorized by it are responsible for their use of the platform and AI Worker; the information, instructions, rules, content, permissions and access they provide; maintaining the authority and necessary rights over supplied data; protecting accounts and credentials; obtaining required notices and consents from end users; reviewing business rules and escalation contacts; and using the service lawfully. To the extent permitted by applicable law, WOWZONE is released from liability for consequences arising from instructions, data, configurations, content, decisions or uses attributable to the customer or persons authorized by it, without prejudice to liabilities that may not legally be excluded.

4. AI behavior and human oversight

Artificial intelligence outputs may be probabilistic, incomplete or inaccurate. The Worker is an automation assistant and not an independently licensed professional. The customer remains responsible for business decisions and for establishing appropriate human oversight. High-risk, regulated, sensitive or professional matters must follow applicable industry controls and human escalation rules. WOWZONE may apply safety controls and reject or redirect requests that exceed configured limits.

5. Customer data and privacy

As between the parties, the customer retains the rights it may have over Customer Data. WOWZONE may process such data to provide, protect, support and maintain the service, subject to the Privacy Policy and, where applicable, the Data Processing Addendum (DPA). Data belonging to different customer organizations must remain logically isolated through tenant or organization separation controls.

6. Integrations and third parties

The customer may authorize integrations with messaging services, Meta/WhatsApp, calendars, payments, artificial intelligence, hosting, telecommunications or other providers. Those services are subject to their own terms, policies, availability and infrastructure. To the extent permitted by applicable law, WOWZONE will not be responsible for interruptions, errors, delays, loss of connectivity, policy changes, suspensions, blocks, unavailability or failures originating exclusively in third-party applications, APIs, platforms or infrastructure, nor for failures or absence of the customer’s or end user’s Internet connection, mobile network, power or telecommunications. WOWZONE will apply reasonable operational measures to preserve or restore its own functionality when possible.

7. Acceptable use

Use of the service is subject to WOWZONE’s Acceptable Use & AI Policy. The customer may not use the service for unlawful activities, deception, unauthorized access, harmful automation, rights violations, spam, circumvention of safeguards or other uses prohibited by applicable law or WOWZONE policies.

8. Intellectual property

WOWZONE and its licensors retain rights in the platform, Core, software, workflows, models, templates, documentation and improvements. The customer retains the rights it owns in its own business data, brand and materials. The subscription does not transfer WOWZONE source code or ownership of the underlying platform.

9. Suspension

WOWZONE may restrict or suspend affected functionality when reasonably necessary for security, fraud prevention, legal compliance, material nonpayment, abuse or a serious policy violation. When reasonably possible, suspension should be limited to what is necessary and the customer should be informed.

10. Service changes

WOWZONE may improve or modify the service. Material changes that substantially reduce contracted functionality should be communicated when reasonably possible. Third-party integrations may change independently of WOWZONE.

11. Disclaimers and warnings

Except for commitments expressly set out in an applicable order or required by mandatory law, the service is provided without a guarantee that AI results will always be accurate, complete or suitable for every decision. The customer must independently verify results when an error could materially affect people, rights, money, health, legal interests or safety.

12. Liability

The customer assumes responsibility for the use that it and its authorized users make of the platform, including business decisions made with support from the AI Worker. To the extent permitted by applicable law, WOWZONE will not be liable for damages or breaches arising from customer misuse, information or instructions provided by the customer, or failures attributable exclusively to third-party services, external applications, APIs, Internet, mobile networks, power or telecommunications outside WOWZONE’s reasonable control. Where a failure, breach or impact directly attributable to WOWZONE is determined and proven, including a situation not expressly anticipated in these Terms, WOWZONE’s economic liability will be limited to reimbursement of the last payment actually made by the customer to WOWZONE for the affected service, to the maximum extent permitted by applicable law. Nothing is intended to exclude or limit liability that may not be excluded or limited under mandatory applicable law.

13. Termination and data

Upon termination, access may end in accordance with the applicable order. WOWZONE will manage Customer Data in accordance with the Privacy Policy, DPA, retention rules and applicable law. Obligations intended to survive termination, including accrued payment obligations, confidentiality, protection of intellectual property and appropriate data obligations, remain in effect where applicable.

14. Governing terms and local law

These global Terms are supplemented by any country- or industry-specific annex applicable to the transaction. Mandatory local rules prevail where they cannot be contractually excluded. For contracting subject to Guatemala, any dispute, controversy or claim related to the service, its contracting, interpretation, performance or termination will be governed by the laws of the Republic of Guatemala and submitted to the competent courts of the Republic of Guatemala, unless mandatory applicable law provides otherwise.

15. Electronic acceptance and versions

The customer expressly authorizes the use of electronic means for contracting and acknowledges that electronic acceptance, electronic signature where applicable, acceptance checkboxes, codes, digital confirmations and other electronic mechanisms implemented by WOWZONE may be used to express consent to these Terms, annexes, orders, authorizations and service documents, in accordance with applicable law. WOWZONE may record the version of the document package, organization, identity or available reference of the accepting person, date and time, IP address or other reasonable technical data and evidence of acceptance. Material updates will apply according to their effective date, notification requirements and applicable law.
